Merchants Bonding Company Claims team is solely focused on surety claims. Our common sense approach to handling surety claims, along with claims handling technology, sets our team apart from our competitors. Our relationships with our partners within the industry are vital to our success and our claims examiners and attorneys deliver a first-class experience in all aspects of the claims process.

 

JOB RESPONSIBILITIES
Claim Investigation and Loss Analysis

Review and analyze correspondence and documents from claimants and principals for loss determination.
Maintain detailed documentation of investigation efforts in the SIMS claim file.
Oversee outside counsel and consultants for claim investigations and defense.
Identify potential sources for salvage, reimbursement, and indemnification, and pursue recovery.
Negotiate with stakeholders and draft legal documentation to resolve claims.
Work with senior claims attorney to develop and implement claim handling strategies.
Draft determination letters and prepare documentation for payments.
Make decisions regarding collateral and indemnity rights.
Audit journal entries periodically and make reserve recommendations.
Review entire principal account, involving underwriters and agents as needed.
Prepare correspondence and documents related to claims.
Attend meetings, mediations, and legal proceedings as directed.
Research and Consultation

Seeks legal counsel or consultants based on claim merits, audits their performance, and authorizes payments.
Stays updated on claims handling requirements in relevant jurisdictions and attends necessary training.
Analyzes bond language, contracts, codes, statutes, and case law for specific claims.
Provides assistance to underwriters, principals, and agents on legal or claim-related questions.
Conducts research and offers recommendations on general legal issues for various Merchants' departments when directed.
YOUR QUALIFICATIONS
Successful Sr. Contract Claims Attorney II's have a Juris Doctorate plus 5+ years of experience in the Surety, Insurance or related industry. Experience investigating and adjudicating claims in the surety industry is strongly preferred.  License to practice law in appropriate jurisdictions.  Per the claims adjuster licensing policy, must acquire within the first 90 days of employment and maintain an adjuster’s license in every state where a license is required. 

 

Strong Organizational Skills: Ability to manage tasks efficiently and handle sensitive information effectively.

Excellent Communication: Above-average written and oral communication skills, including the ability to communicate with diverse personalities.

Problem-Solving and Decision Making: Proficiency in problem-solving and making decisions, especially in time-sensitive situations.

Technical Proficiency: Proficient in Microsoft Outlook, Word, Excel, and other Office Suite applications, as well as various office equipment.
